Notice of Intent to Amend Existing Rules and Regulations – Chapter 62
These rule changes were initiated in response to requirements by the US Environmental Protection Agency (EPA) under the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) and the United States Department of Agriculture’s rescission of the federal recordkeeping regulations (Docket No. AMS-AMS-25-0019).
The draft changes to the current Chapter 62 rules and regulations include the following changes:
- Rescission of private applicator recordkeeping requirements for the use of Restricted Use Pesticides (RUPs).
- Clarifies recordkeeping requirements for Commercial Applicators using RUPs and general use pesticides in the state of Wyoming.
- Allows family members or employees of a certified applicator to purchase or procure RUPs on behalf of a licensed applicator.
- Clarifies the Department’s definition of “good standing” related to reciprocal licensing.
- Update’s the Department’s process for denying a reciprocal pesticide applicator’s license.
Individuals can download, review and provide online public comment regarding Chapter 62 on the Wyoming Secretary of State’s Administrative Rules website at: https://rules.wyo.gov/ . Public comment will be accepted until November 24th, 2026.
